When facing the prospect of filing for divorce as well as bankruptcy, the question that arises is which should I do first? If the debts that you are faced with are marital debts, then it would be in your best interest to consider filing for bankruptcy first.  By doing so, you will discharge all marital debts.  You may file for divorce while the bankruptcy is proceeding; however, the divorce will not be finalized until the bankruptcy proceedings are completed.  By taking this course of action, you will come out of the divorce without having to worry about the marital debts.
