Beginning January 1, 2017, the Illinois Employee Sick Leave Act takes effect. This Act expands the reasons that an employee can use paid sick leave where paid sick leave is already provided by an employer.

Under the Act, an employee may use personal sick leave benefits for absences due to an illness, injury or medical appointment of the employee’s child, spouse, sibling, parent, mother-in-law, father-in-law, grandchild, grandparent or stepparent, for reasonable periods of time as the employee’s attendance may be necessary, on the same terms upon which the employee is able to use sick leave benefits for the employee’s own illness or injury. An employer may limit the use of personal sick leave benefits provided by the employer to an amount not less than the personal sick leave that would be accrued during 6 months at the employee’s then current rate of entitlement.  An employer may provide greater sick leave benefits than those provided for under the Act.

Employers should update existing policies to comply with the Act.
